1. Introduction

Touch-A-Life and its affiliates (referred to here as “TouchALife,” “TALGiving” the “Company,” “we,” “us,” or “our”) are dedicated to protecting your privacy and safeguarding your personally identifiable information. This Privacy Policy describes how we collect, use and share information about you that we obtain through your use of TALGiving (collectively referred to as the “Products & Services,” or “Services”).

By using our Services, you are accepting and consenting to the practices described in this Privacy Policy (including as changed from time to time). If, for any reason, you do not agree to the terms of this Privacy Policy, please stop using our Products & Services immediately.

INFORMATION WE COLLECT

As further described below, when you use or otherwise access the Services, we collect information in multiple ways, including when you provide information directly to us, and when we passively collect information from your browser or device (e.g. by logging how you interact with our Services). If you do not wish to provide us with the following information, please delete your account or send us an email to support@touchalife.org and do not use our Products & Services in any way.

DISCLOSURE TO THIRD PARTIES

    A. Information That You Provide Directly to Us:

  • I. Registration information:

    When you register for our Services or open an account, we collect your contact and log in details, your zip/post code, your country and any information you choose to provide us with (such as a profile picture).

  • If you are a charity and you establish an account with the TALGiving Charity Platform, we will collect the name, tax ID, physical address, email address, date of birth and phone number of the person who establishes a charity account and claims your charity (the "Charity Contact") and any other information that is provided to us about your charity. We may also collect, if the Charity Contact chooses to provide it, the Charity Contact’s gender or any photos uploaded to the Site. You can edit your information by logging in to your account and making changes at any time.   • II. Creating a fundraising campaign:

    When you create a campaign on our Platform, we collect the information you choose to provide us with in relation to your campaign. For example, you can provide a campaign title, choose a campaign category, upload images and describe your campaign goal(s).

    Our payment processors collect and retain information related to your withdrawal of funds from any campaign.

  • III. Donation information:

    On our Platform, when you donate to a fundraising campaign, we collect your contact details (such as name and email address), zip or post code, country and any other information you choose to provide us with (such as a description of why you have donated). Our payment processors collect your credit card details and other information needed in order to process the donation.

  • IV. Information relating to third parties:

    We do not display your contact information publicly on our site or disclose personally identifiable information to third parties, except for when (1) we have your permission to make the disclosure, (2) the disclosure is necessary for the purpose for which the information was obtained, (3) a third party is assisting us to provide or manage the services or website, or (4) where otherwise stated in this policy. We also may disclose information where permitted by applicable law or when the disclosure is necessary, in our sole discretion, for the establishment or maintenance of legal claims or legal compliance, to satisfy any law, regulation, subpoena or government request, or in connection with litigation.

    You can choose to provide us with information relating to third parties. For example, if you choose to share your campaign on the Platform with family and friends, we request access to information stored in your email and mobile device address books, such as names, email addresses or phone numbers of your contacts (collectively, "Third-Party Data").

    If you use any feature of the Services that allows you to communicate with third parties (such as to refer a third party to the Services or to communicate with them regarding a campaign or a donation), either by submitting Third-Party Data to the Services or otherwise permitting the Services to automatically access Third-Party Data in your possession, you acknowledge and agree that you have the authority of the relevant third party for us to access and use the relevant Third-Party Data and that you have notified these third parties and informed them how their information is collected and used by TALGiving to provide the Services.

  • V.Sensitive information:

    You can also provide us with information about yourself or third parties that is considered sensitive, such as political opinions, health-related information or religious beliefs. When you provide such information to us directly, we may seek your consent, where appropriate, to process this information, unless you choose to provide such information to be published publicly in relation to your campaign or donation or otherwise.

    B. Information that is collected passively or automatically:

  • I. Device & Usage Information:

    When you interact with TALGiving through the Services, we automatically receive and store certain information from devices that you use to access the Services. This information is collected passively by using various technologies and includes the type of internet browser or mobile device you use, any website from which you have accessed the Services, your operating system and location data through an IP address that identifies the city and state where you logged into the Platform or your precise geo-location if you have permitted your mobile device to provide that information to us. TALGiving either stores such information itself or such information is included in databases owned and maintained by TALGiving or its agents or service providers.

  • II. Aggregated Data:

    In an ongoing effort to better understand the use of our Services and serve you, TALGiving often conducts research on its customer demographics, interests and behavior based on information that we collect. We can anonymize and aggregate the information collected through the Services for research purposes or any other purposes, and we can share this information with our affiliates, agents, business partners or other third parties (e.g. Google Analytics).

  • III. Location Information:

    When you use the Services to organize a fundraising campaign, the Services request that you provide your city or town, and state or province or county etc. of residence. Please bear in mind that other users of the Services can view your city or town and state or province of residence in connection with the campaign if it is made available within TALGiving Public Search Directory. We also use your location information as described above under "Device & Usage Information", and in an aggregate way, as described above in the "Aggregated Data" section.

  • IV. Cookies and Other Electronic Technologies:

    A “cookie” is a piece of text which asks permission to be placed on your computer’s or device’s hard drive. Once you agree, this cookie file is stored on the hard drive of your computer or device.

    A cookie is a small amount of data, which often includes an anonymous unique identifier, that is sent to your browser from a web site's servers and stored on your computer's hard drive. Cookies are required for our service. We use cookies to track and record user session information. Some examples include keeping you logged into your account while keeping your session secure, views of specific pages or modals, and the number of password reset requests. We do not use permanent cookies but will require users to log in periodically to our site in order to help protect your account information.

  • V. Other technology

    Web beacons: Additionally, emails we send may contain a bit of code known as a "web beacon." This code allows us to understand the time and date of when a user has opened an email and when he/she has utilized a link within the email to visit a website. Our web beacons do not collect personally identifiable information and you may disable our web beacons. Please see your email client for more information regarding disabling web beacons.

    LOG FILES: Like many other web sites, the Company makes use of log files. The information inside the log files includes internet protocol (IP) addresses, type of browser, Internet Service Provider (ISP), date/time stamp, referring/exit pages, and number of clicks to analyze trends, administer the site, track user's movement around the site, and gather demographic information.

    You may request us to stop the collection of tracking information at any time by adjusting the settings on your device, or contact us at support@touchalife.org. Please note that disabling these features may render some or all of our Products & Services unavailable.

    When you register for an account with us, we may collect additional information automatically from you. For example, when you choose to connect your e-mail account with our system, the Company may collect additional information from you, including the content of your e-mail messages, your contacts, and entries in any calendars associated with your e-mail account. IT IS YOUR RESPONSIBILITY TO CONFIRM THAT YOU HAVE THE RIGHTS TO CONNECT YOUR E-MAIL TO OUR SERVICES. BY CONNECTING A WORK E-MAIL TO OUR SYSTEM, YOU REPRESENT THAT YOU HAVE OBTAINED ALL NECESSARY CONSENT FROM YOUR EMPLOYER AND THAT YOUR EMPLOYER HAS READ AND CONSENTED TO OUR PRIVACY POLICY. You may choose not to connect your e-mail account to our system, however, certain parts of our Products & Services may not work.

  • C. Information from or to Social Networking Services

  • One of the special features of the Services is that it allows you to enable or log in to the Services via various social networking services like Facebook or Twitter, or upload videos using YouTube APIs ("Social Networking Service(s)"). By directly integrating these services, we aim to make your online experiences richer and more personalized. To take advantage of this feature, we will ask you to provide your user details for the applicable Social Networking Service in order to log in to our Services. When you add a Social Networking Services account to the Services or log into the Services using your Social Networking Services account, we will collect relevant information necessary to enable the Services to access that Social Networking Service. As part of such integration, the Social Networking Service will provide us with access to certain information that you have provided to the Social Networking Service (for example, your name and photograph, as well as other information that you permit the Social Networking Service to share with us).

OUR USE OF INFORMATION COLLECTED

TALGIVING uses the information collected from the Services in a manner that is consistent with this Policy. We use the information that you provide (or otherwise permit the Services to access) for the following purposes:

  • A. Communicating with You

    We use the information we collect to contact you for administrative purposes (e.g. to provide services and information that you request or to respond to comments and questions). We also use the information we collect to send you communications relating to the Services, such as updates on promotions and events, communications relating to products and services offered by us and by third parties, and communications about services we believe will be of interest to you. For example, we can send periodic emails to registered users of the Services relating to their recent interactions with the Services, such as donating to a campaign or "hearting" a campaign.

    Mobile Services: If you access the Services through a mobile device and if you have chosen to provide us with your mobile number or other electronic means to your mobile device, you agree that we can communicate with you regarding TALgiving by SMS, MMS, text message.

  • Providing the Services

    We use the information we collect to operate, maintain and provide our Services such as enabling access to the Platform, customer support or to complete transactions. Also, as part of the TALGiving Service unique to the TALGiving Charity Platform, we may provide (i) a report to campaign or event organizers that tells them who responded to a particular offer or to facilitate the fulfillment of an order that you have made; or (ii) data related to the establishment of a donation registry and the applicable charities, campaigns on the TALGiving Charity Platform that established the donation registry.

  • B. Analytics and Product Development

    We use the information we collect to analyze data usage trends and preferences in order to improve the accuracy, effectiveness, security, usability or popularity of our Services.

  • C. Customization

    We use the information we collect, such as device identifiers, to learn how users interact with our Services in order to personalize the content of our Services, such as customizing the language and campaigns on our home page based on your location.

  • D. Legal

    We use the information that we collect to defend our legal rights, comply with state, local, federal or international laws and enforce our Terms of Service and this Policy.

    OUR DISCLOSURE OF INFORMATION COLLECTED THROUGH THE SERVICES

    There are certain circumstances in which we share information collected through the Services with certain third parties without further notice to you, as set forth below.

  • A. Business Transfers:

    In the event we are acquired by or merged or consolidated into another entity, or if there is a sale of our assets, your information may be transferred to the entity acquiring us or our assets or the entity that survives the merger or consolidation. You acknowledge and agree that in the foregoing circumstances, your information may be disclosed to such third party.

  • B. Agents, Consultants, Vendors and Related Third Parties:

    We do not display your contact information publicly on our site or disclose personally identifiable information to third parties, except for when (1) we have your permission to make the disclosure, (2) the disclosure is necessary for the purpose for which the information was obtained, (3) a third party is assisting us to provide or manage the services or website, or (4) where otherwise stated in this policy. We also may disclose information where permitted by applicable law or when the disclosure is necessary, in our sole discretion, for the establishment or maintenance of legal claims or legal compliance, to satisfy any law, regulation, subpoena or government request, or in connection with litigation.

  • C. Legal Requirements:

    TALGiving can access, disclose, transfer and retain your information when we have a good faith belief that doing so is necessary to: (i) comply with the law including with subpoenas, search warrants, court orders, and other legal process; and respond to enquiries or requests from government, regulatory, law enforcement, public authorities, or content protection organizations; (ii) protect and defend the legal rights, privacy, safety or property of TALGIVING, its affiliates, subsidiaries, employees, agents, contractors or its users; (iii) permit us to pursue available remedies, commence, participate in or defend litigation, or limit the damages we may sustain; or (iv) enforce this Policy or any applicable Terms of Service.

  • D. Your Choice

    You may have the opportunity to receive certain communications from us related to our Services. If you provide us with your email address in order to receive communications, you can opt out at any time by using the unsubscribe links at the bottom of our emails. Please note that certain emails may be necessary to provide you with our Services. You will continue to receive these emails, if appropriate, even if you unsubscribe from our optional communications.

UNSOLICITED INFORMATION

Please be advised that some information that you provide may be publicly accessible, such as information posted in forums or comment sections. We also collect information through customer support communications, your communication to us of ideas for new products or modifications to existing products, feedback and other unsolicited submissions (collectively, with publicly-accessible information, "Unsolicited Information"). By sending us Unsolicited Information, you further: (a) agree that we are under no obligation of confidentiality, express or implied, with respect to the Unsolicited Information, (b) acknowledge that we may have something similar to the Unsolicited Information already under consideration or in development, (c) grant us an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license to use, modify, prepare derivative works, publish, distribute and sub-license the Unsolicited Information, and (d) irrevocably waive, and cause to be waived, against TALGiving and its users any claims and assertions of any moral rights contained in such Unsolicited Information. This Unsolicited Information section shall survive any termination of your account or the Services.

CHILDREN

Our Website is not directed to individuals under the age of 13, and we request that individuals under 13 not provide personal data to the Company. We do not knowingly collect personal information from persons under the age of thirteen (13) without verifiable parent consent. If we learn that a child under the age of thirteen (13) has submitted personally identifiable information online without parent consent, we will take all reasonable measures to delete such information from our databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law). If you become aware of any personally identifiable information we have collected from children under thirteen (13), please contact us at support@touchalife.org, If you are a member or contact of one of our customers, you should review their privacy policy to determine their privacy practices with respect to children’s data.

EXTERNAL LINKS

Our Products and Services may include links to and from the websites of our partner networks and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for such privacy policies. Please check the privacy policies applicable to any other website you access via the Website before you submit any personal information to such other website.

SECURITY

We take precautions, but cannot provide guarantees. We do our best to secure your data through the programming of our services and the use of security measures that we deem appropriate for the type of data provided. However, we cannot completely guarantee that no part of our system or site will ever fail or be compromised. If you ever suspect that our site or services has contributed to your personal information being compromised, please contact us at support@touchalife.org immediately so that we can investigate and try to resolve the matter.

FOR CALIFORNIA VISITORS ONLY: YOUR CALIFORNIA PRIVACY RIGHTS.

California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information. As discussed elsewhere in this Privacy Policy, we do not currently share the personal information of California residents with third parties for their own direct marketing purposes. However, if you have further questions about our privacy practices and compliance with California law, please contact us as explained below.

If you are a California resident, the California Consumer Privacy Act provides you with the following rights with respect to your personal information:

The right to request to know the categories or specific pieces of personal information we have collected, used, disclosed and sold about you. To submit a request to know, you may email us at support@touchalife.org. The right to request that we delete any personal information we have collected about you. To submit a request for deletion, you may email us at support@touchalife.org. You also may designate an authorized agent to make a request for deletion on your behalf on our website on This Link.

When you exercise these rights and submit a request to us, we will verify your identity by asking you to log in to your account if you have one with us. Or if you do not, we may ask for your email address and require additional verification. We also may use a third party verification provider to verify your identity.

The fact that you have elected to exercise these rights will have no adverse effect on the price and quality of our Services.

The Company does not and will not sell your personal information.

Minors Under 18 in California

Minors under 18 years of age in California may have the Personal Information that they provide to us through the Website deleted by sending an email requesting deletion to support@touchalife.org. Please note that, while we make reasonable efforts to comply with such requests, deletion of your personal information does not ensure complete and comprehensive removal of that data from all systems.

California Do Not Track Disclosure

Some Internet browsers include the ability to transmit “Do Not Track” signals, which is a privacy preference that users can set in some web browsers, allowing users opt out of tracking by websites and online services. Since uniform standards for “Do Not Track” signals have not been adopted, TALGiving does not process or respond to “Do Not Track” signals.

RETENTION OF YOUR INFORMATION

We will only retain the information for as long as necessary for the purpose for which that information was collected and to the extent permitted or required by applicable laws. When we no longer need to use your information, we will remove it from our systems and records and/or take step to anonymize it so that you can no longer be identified from it in accordance with our internal document retention policies.

When determining the retention period, we take into account various criteria, such as the type of products and services requested by you or that you are provided with by us, the nature and length of our relationship with you, possible re-enrolment with our products or services, the impact on the services we provide you with if we delete some information about you, mandatory retention periods provided by law and the statute of limitations.

PRIVACY INFORMATION FOR VISITORS FROM THE EU

If you are in the European Union (EU), you have certain rights in relation to your personal information under the EU’s General Data Protection Regulation 2016/679 (GDPR) and other applicable European data privacy laws.

The Company is the controller of personal data submitted by you or otherwise collected when you use the Site and Services. Please note, however, that the Company is not the controller of third-party data you may submit to our Service. We process such information within the Service solely in the processor’s role and, depending on the scope of your activity, you may be the data controller.

Rights to Control Your Personal Information

You have certain rights with regard to your personal information under the European data privacy laws. If you would like to request a copy of your personal information being held by us, request that your personal information is deleted, request to update and/or correct your personal information, or request that we provide a copy of your personal information to another data controller, please contact us. We will aim to respond to your request within one calendar month of receipt of your request. Where we are unable to do so within the calendar month, we will notify you of the soonest practicable time within which we can respond to your request (and within three months from the date of your request). There are certain exemptions and restrictions of these rights under the European data privacy laws that enable personal information to be retained, processed or withheld from access and we will inform you of these restrictions if they apply.

We use your Personal Information for the following key purposes, as described above in the Privacy Policy:

  • for our legitimate interests and those of a third party; and
  • for our business purposes.

TRANSFER OF YOUR INFORMATION; PRIVACY SHIELD

The Products & Services are provided from the United States. If you are located anywhere outside of the United States, please be aware that information we collect, including, Personal Information, may be transferred to, processed and stored in the United States or other countries in accordance with this privacy policy. Where the data transfer route is no longer available, an appropriate alternative will be put in place. The data protection and other applicable laws of the United States or other countries may not be as comprehensive as those laws or regulations in your country or may otherwise differ from the data protection or consumer protection laws in your country. Your information may be available to government authorities under lawful orders and law applicable in such jurisdictions. By using the Products & Services and/or providing personal information to us, you consent to transfer of your information to our facilities as described in this Privacy Policy.

Please be informed though that the Company and its controlled subsidiaries do adhere to the principles of the EU-U.S. and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union or Switzerland to the United States. Therefore, you can feel free to legally transfer processed personal data to our systems. The Company will occasionally update this Privacy Policy to reflect company and customer feedback. The Company encourages you to periodically review this Statement to be informed of how The Company is protecting your information.
